Le contrat à distance en droit québécois et en droit européen

Abstract

L’émergence importante de technologies durant notre ère a forcé le gouvernement québécois à actualiser et à préciser les règles existantes en matière de contrats de consommation conclus à distance. C’est en 2006 qu’il introduit la Loi modifiant la Loi sur la protection du consommateur et la Loi sur le recouvrement de certaines créances. Le 25 octobre 2011, le Parlement européen et le Conseil de l’Union européenne adoptent la directive 2011/83/UE, ayant comme objectif de contribuer au bon fonctionnement du marché intérieur et d’assurer un haut niveau de protection pour le consommateur européen en matière de contrat à distance. Le présent article a pour objectif de procéder à une étude comparative de la législation québécoise et de la législation européenne en matière de contrat à distance, en prenant soin d’identifier les ressemblances et les différences des deux régimes.

The advancement of technology during our era has forced the Québec government to modernize and clarify the existing legislation governing distance contracts. In 2006, the Québec government introduced An Act to amend the Consumer Protection Act and the Act respecting the collection of certain debts. On October 25th 2011, the European Parliament and the Council of the European Union adopted the Directive 2011/83/UE, with the objective of contributing to the proper functioning of the internal market and assuring a high level of protection for the European consumer, with respect to distance contracts. The present article deals with a comparative analysis between the Québec and the European legislation with regards to distance contracts, with particular emphasis on identifying the similarities and the differences between the two regimes.
