Résumé
Cet article vise à faire la lumière et à sensibiliser les lecteurs à une problématique bien particulière en droit de la responsabilité médicale, soit la controverse entourant la rétention de la responsabilité d’un médecin ou d’un centre hospitalier lorsqu’une faute alléguée est liée, de près ou de loin, à une certaine limitation des ressources allouées par le gouvernement québécois. L’auteur met l’emphase sur l’adaptation à la réalité particulière du domaine médical des critères permettant d’établir la rétention de la responsabilité d’un médecin ou d’un centre hospitalier lorsque ceux-ci sont assujettis à une obligation de moyens et dresse un portrait de la controverse qui existe dans la détermination de la limitation des ressources en milieu hospitalier en tant que circonstance aggravante ou atténuante de la responsabilité du médecin ou du centre hospitalier pour mieux se pencher sur certaines pistes de solution qui permettraient de mettre un terme aux injustices découlant du flou juridique sur la question.

This article aims to shed light and to raise the reader’s awareness to a very particular legal problem related to medical responsibility, which is the controversy surrounding the retention of a physician or a hospital when an alleged fault is linked, near or far, to some limitation of resources allocated by the Government of Quebec. The author focuses on adaptation to the particular reality in the medical field of the criteria for determining the retention of the responsibility of a physician or a hospital when they are subject to an obligation of means and provides a portrait of the controversy that exists in the determination of the limitation of resources in a hospital as a circumstance aggravating or mitigating the responsibility of the physician or the hospital to better focus on some tracks of a solution that would put an end to the injustices arising from the legal uncertainty on the issue.
